Fighting the IRS involves formally appealing decisions, using the Independent Office of Appeals (Appeals). Appeals is separate and independent from the examination and collection branches of the IRS. They are geared toward resolving tax disputes without litigation. Appeals pledges to act impartially toward both the taxpayer and the government.
You can also seek help from the Taxpayer Advocate Service (TAS). Use the TAS if you’re facing financial hardship, or have experienced IRS system failures. The TAS is another agency within the IRS that is separate and independent.
When You Get a Notice from the IRS
The vital thing when you get a written notice from the IRS is not to ignore it. You’ll want to file your appeal within 30 days of the notice. Be sure to adhere to any and all deadlines the IRS issues.
Gather all the documentation you can to support your position. Communicate through formal letters and maintain copies of all correspondence.
You may want to seek out professional help as well. This might be an accountant, a tax attorney, or an Enrolled Agent. In fact, the IRS itself recommends getting this support, especially for cases involving audits or tax court.
